Legal Question in Workers Comp in California
Hello I was recently won an award from the CA WC which states a lump sum payment and future medical care. My attorney told me that since I am still working for the same employer they could not fully close the case as I am still covered under their insurance. He mentioned that if I ever get worse I could go back and ask for a review of the claim and get some extra money from my employer. Also since I got medical care I would like to know how to file a claim. Any way I could close this case once and for all? Thanks!

Why do you want to close the case? The only element of the case that is open is further medical treatment. Your ability to get additional money arises from either claiming a new injury from work or your current condition worsening within 5 years of the date of the injury, assuming that you did not enter into a compromise and release as to your PD [that is normally why a lump sum payment is made]. Filing a claim merely requires filling out the simple employee first report of work injury.
