Legal Question in Workers Comp in California

Recipient of Workers Comp Develops Dementia

A friend was injured on the job 22

months ago. He is presently receiving

workers Comp paid-for hospital

treatment for physical disabilities

arising from a physical on-the-job

injury. Unfortunately, not only has

he failed to recover, and it appears

that he never will recover from the

physical disabilities, he has lapsed

into a state of dementia. Does

worker's comp continue to be

responsible for his care?

I would recommend that your friend seek counsel. More likely than not, the insurance company will dump your friend off to the side. Please have a representative of your friend contact my office for a free consultation at 818.385.0520.

Re: Recipient of Workers Comp Develops Dementia

Yes, since the dementia was caused and manifested by a work-related injury. Your friend should immediately amend his WCAB claim and application and add dementia as an injury. Feel free to call us for a free consultation about your case.
