Legal Question in Workers Comp in California

re-injuried / new injury

I am a mechanic who injured himself in Feb of 05 that ended up being a labral tear and an elbow tendon problem. I was released with restrictions in Oct. 06 not to work overhead with my right arm. Last week I injured myself again. At this point it looks to be rotator cuff which was not in the original claim.I am now waiting to find out for sure. I was cleared to work and my new enployer has my release on file. How is this going to work? I was working within restrictions. I recieved paperwork from the W/C group asking for all my old records. Do I have to provide them? I am concerned about providing them a release to research my records as I have found in California, I tend to get screwed. What is my best choice in this situation? My previous w/c lawyer did not particularly care so it is not an option for me to contact him for advise.

You are in a very complex situation. Your new employer is seeking to blame your new injury on your old injury in order to reduce or eliminate its liability.

Pursuant to Labor Code, Section 4663, your new employer is entitled to explore your past injury(ies) for apportionment purposes. In order for you to get an admissible medical report, your new doctor has to review all the records in order to make a proper determination. This includes records from your prior doctor(s).

You are probably seeing a doctor within your new employer�s Medical Provider Network (MPN). You might be eligible to find a physician outside of the MPN. However, without reviewing all the facts of your case, it will be impossible to advise on this issue.

I advise you immediately to get a new attorney. The defense will access your medical records whether you like it or not. I also suggest that you be upfront and truthful about your old injuries in the depositions and with QME/AME doctors.
