Legal Question in Workers Comp in California

Relocating before case is settled

I went out on TPD in Ocober 2005. In December, 2005 I was declared P&S. Physicians have stated I will be QIW. (My date of injury is October 2003). The final report is still pending so I am currently in limbo. However, my spouse accepted employemnt in another California city and we recently relocated. What affect, if any, will this have on my WC case?

Medical treatment & benefits

The carrier may object to treatment if you do not find a suitable physician within a reasonable distance from your new residence. Additionally, there may be some glitches in payment of your disability benefits. To protect yourself I recommend that you immediately file a change of address with the court and serve the same on all parties. That way, if your payments are late, the carrier cannot place the blame on your failure to provide an updated address. If the move is substantial, you might consider a change of venue. My recommendation is to speak with the I&A representative if you do not have an attorney.

Other than having to drive further to see your doctor, a deposition, etc., there should be no impact at all.
