Legal Question in Workers Comp in California

Who's responsible ?

Arev the insurance companies responsible to pay in for my social security taxes each year that I have recieved Temp. disability payments ? As I have been set on back burner during recent litigations and have been on temp. disability for 5 years now waiting for corrective surgery. On my yearly Social Security Statement , it shows that I have not paid into for the last 5 years, bringing my average down considerably, meaning lower monthly social security income when I retire. (IF still around). The pause in care is not on my behalf. If I am to be helped as if I was working, Does it not mean in its entirety?

Re: Who's responsible ?

The short answer is that the insurance company is not responsible for paying into your social security account. The main reason is that your TTD disability payments are not considered income which is why no taxes of any kind are taken out of the checks.

If you are severely injured, you should also think about filing for social security disability benefits as well because after 5 years of not working, you may not be eligible for much longer until retirement age.
