Legal Question in Workers Comp in California

I am a restaurant manager that works 10 to 12 hours a night and serve and cook to be able to give my server and cook a break. When my doctor put me on modified work for 8 hours a day and no serving or cooking, my boss told me I was no better than a walmart greeter. Can he get away with this?
