Legal Question in Workers Comp in California
Any rights?
Limited daily llife due to pain and suffering from a cyst tumor next to spiine and becoming worst every day.Restricted from employment by doctor as iam placed under pain management with vicodin somas and methodone as doctor refuses the recommended surgery due to risk of paralize. From an injury sustained and reported and daily complained of for 3yrs until hospitilized for aggravating same injury thus becoming the 3rd reported injury I was denied any medical attention each time then discharged upon returning from my requested medical leave as well as evicted from premises.A white employee was treated for an injury while another white fired allowed continue residing on premises. Is it right to be treated differently and cont suffering after wrongly discharged with pain from work injuries?

The easy answer is No, it is not right, but the real question is: Is it legal? I say no. Of course it depends upon why the evicted you and if they have accepted the claim. I have several questions for you. 1. Did you file a claim for workers' compensation? When did this occur? Is there a workers' compensation case still open? Did you receive any benefits? What was your job and are you claiming that condition is due to your work?

At first glance if the treated you differently (discriminated) than the white employees you may have a cause of action for discrimination based on disability and race. If you are over 40, you may have a claim of disability based on age.
There are several things you can do. If you live in a residential facility and/or are also an employee you have possible workers' compensation rights. If you are not an employee you still may have some discrimination rights as mentioned above.
