Legal Question in Workers Comp in California

What are my rights?

A month ago, I was injured changing a beer keg at work. I was told at my first visit to the work comp doc that I was very injured, but that they are not aloowed to say that we can not work. So, I was told I had to do extreme limited light duty. But I was on several different pain meds and in serious pain for a shoulder and neck injury. Employer would not allow me to have any time off unless I used my vacation time. They told me to show up, but my hours were going to be severely cut to accomadate the doctor report. I told them that I was in zero condition to work, but they insisted that I had to so I quit. Now I have found out that I have a bulging disc in my neck and I am not allowed to lift anything over ten pounds. Am I entitled to any kind of financial reimbursement? I haven't even been able to pick up my 2 year old child since this has happened and I am being told that because my employer is an Indian casino, that I am not entitled to any kind of compensation other than my doctor bills. My income was necessary around this house, but I am currently getting nothing. Please help!

Re: What are my rights?

Normally, you would hire an attorney who would then send you for medical treatment and your case would be "on." However, whether or not working at an Indian casino would fall under the jurisdiction of the California Department of Industrial Relations is an interesting question and would require some research. I will look into this. Please feel free to call my office at, 818.385.0520 or shoot me an email next Wednesday and I will be glad to let you know what I learned.
