Legal Question in Workers Comp in California
Where as the SBA considers a wife working 40 hours a month an employee wheather compenisated or not. Under the california workers comp. law is the wife exempt as is the husband?

In WC the owner of the business is exempt from having coverage because the owner is not an employee. If the owner's wife works fo rthe business, is she doing it as an employee or as a part owner? If she is receiving no salary, it would seem she is not an employee. The purpose behind the SBA rules is different so the conclusion may also be different.
