Legal Question in Workers Comp in California
scheduling dr appts for worker's comp imjury
A friend was injured at work in a warehouse. He is on light duty in the office but our employer is requiring him to make his doctor appointments during his own time. Can they do that? Shouldn't he still be paid by worker's comp for his doctor's appointments?

The law is a bit confusing regarding TTD for doctor's appointments. If your friend has already settled his case, the answer is yes, the employer is not responsible to pay for lost wages. However, if the case has not settled, then it can be argued that TTD is owed. The problem is that litigating the TTD payment for one day is not cost effective unless other issues are preseeing as well. In other words, if your friend wants to litigate the TTD issue, he will miss even more time from work for which he will not be paid.

Your friend may need to be on temporary disability benefits while he is treating. So if his treating doctor is from the MPN and insurance company, I am not surprised why his treating doctor has refused to take your friend off work on temporary basis. If he is not ready to work, he may consider changing his treating physician. Please have him contact us at 213.388.7070 for a free consultation.
