Legal Question in Workers Comp in California

How much do I settle for?

I worked for the county and fell down stairs. I have had four surgeries and three slipped discs in my back. I also have a psyche claim. Its been almost six years and finally coming to an end. I have my first settlement conference in a week. How much do I settle for if my impairment is more than 24%?

Re: How much do I settle for?

You need an attorney who has gone through all the medical records and is familiar with the State's disability program. None of us can give you an intelligent opinion with so little information, except to say that you should probably end up with substantially more than a 24% PD rating [inability to do anything but light work is 50% PD]. The WC Judge wil reset the settlement conference. If you already have an attorney and yhou are asking us because you do not trust your attorney, you better have a detailed discussion with that attaorney. It does not cost you anything more to fire one attorney and hire a new one to do the WC case.

From what you are describing your rating should be more than 24%. Did you have a AME or Defense QME? Also the final settlement depends on extent of future treatment and many other factors. Call us at 213.388.7070 if you need representation.
