Legal Question in Workers Comp in California

Settlement Cashout vs Future medical

I had a Cyst Removed & possible Radial Nerve Syndrome. What is the average on a settlement award for this as a cash out? What does Future Medical mean? I am done w/ PT, release from the doctor. I would like to know my options in order to make a decision regarding final close out. The doctor was fine, no complications, other than my arm hurts with exessive movement. Again it possible radial nerve syndrome.

Re: Settlement Cashout vs Future medical

All these questions should be answered at the conclusion of a panel QME examination or an Agreed Medical Examination (AME). In your case there may be additional body parts that were not identified in your original claim and therefore your claim has to be amended. In your case AME may recommend additional surgeries and some reasonable period for recovery and additional therapy and future medicals after your surgery. However, The selection of the examiner and gathering the best medical evidence requires an experienced worker's compensation attorney. If you need representation, please call us at 213.388.7070.
