Legal Question in Workers Comp in California

I have received a disability rating of %49 and was given 5 yrs. disability payments and lifetime medical care for injury to SI Joint and cervical muscle strain. Apparently forms never sent to judge to sign off on 4 yrs. ago. Now insurance company wants me to get a supplemental evaluation and settle the medical care for a dollar amount. The date of injury was 5/17/99. What would be their motivation and what should I do to protect myself?

I cannot tell from the information provided what problems you may face. Normally you want to have your disability reduced to an award and your need for medical care reduced to an award within five years from the date of injury. Certain disputes may need to be resolved within one year. However, sometimes what you have been told by the insurance company may extend some time limits.

You need to talk with a lawyer that does worker compensation. You should gather all of your correspondence and papers received from the beginning of the case and have an attorney review it all. Do not delay. Any further delay might cause you to lose rights.
