Legal Question in Workers Comp in California

Settling my W.C. case

I was P&S's October of 2003. The W.C. Insurance doctors disagreed with my doctors reports. I went to an Ortho AME and a Rhuematogist AME. Should the rating and value of my case be based on the P&S date? and not on the new laws of 2004?

In your case because you were P & S prior to 1/2005, the old schedule applies. If you are not represented, call us at 213.388.7070 for a free consultation about how to get maximum amount of settlement on your case.

The rates are based upon what was in effect upon the date of injury.

Why has it taken 4 years and still no rating? Once you are P&S or have returned to work, the carrier is supposed to make reasonable advances of permanent disability benefits and is subject to paying you an extra amount if they have not made the advances.
