Legal Question in Workers Comp in California
I was being sexually harrassed at work when I reported it I was placed on worker's compensation for stress since I saw a doctor who said that I was suffering from mental distress and depression. I pursued a sexual harassment case and it was settled for a small settlement. Now I find out that my employer denied my worker's compensation claim. My question is can they without my consent put me on worker's comp. then deny the claim.

Your employer can deny your claim for workers' compensation within 90 days from the time they received notice of your work-related injuries. However, if they failed to deny your claim within the 90 period, then your employer will most likely be responsible for your work comp benefits.

Normally you can not get both civil damages and WC benefits for the same injuries; that is the trade off for the WC system existing.
