Legal Question in Workers Comp in California
sister works for UPS. injured on job, diagnosed bulging disc, put on lighter duty and tried several treatments including PT. Two weeks ago had a cervical epideral needle went in too far and caused spinal fluid leakage. Dr tried to fix with blood patch and sent her home. She became so ill with migraine and throwing up, couldn't keep pain pills down. Dr infomed her to go to ER and get a pain injection. Did. On Monday morning called Dr because she was no better and asked to be seen, was told Dr had no openings until Wed. Took her to ER that day and she was admitted for hydration and pain control. Thought was only going to be there overnight, but was there 9 days. She is now home and slowly getting better. While she was in the hospital UPS called and asked her if she had a lawyer, she replied she didn't know she needed one, but now we are seeking advice and the behavior of this DR. Should we conrtact a lawyer? Thank you.

You need to retain an experienced attorney to represent her in the worker's compensation case. As far as the medical malpractice we need more details but the employer is still liable for the original injury and all the foreseeable consequences.
