Generally, you must notify your employer of the injury within 30 days of incurring the same. There some exceptions. You must also file an Application for Adjudication with the Workers' Compensation Appeals Board within 1 year of the injury. I strongly encourage you to speak to a workers' compensation attorney as soon as possible to ensure that the injured worker does not lose any rights or benefits.
There are a lot of exceptions to general rule that a claim must be filed within 1 year. For exeample if you have a continued treatment or continued employement then the execption may apply. Feel free to call us at 213.388.7070 for a free consultation.
