Legal Question in Workers Comp in California
Stress Claim
I'm a ''transportation aid'' at a local hospital.
2 months ago, suddenly, started suffering of excessive high blood pressure. This problem has landed me 4 times at the emergency room, 2 times at brink of a stroke.
don't know if while transporting any chemicals/pacients to/from the lab, morgue, etc., I could have been exposed to something that now is undermining my health. Also I have been under a lot of stress due to job related duties, pressure from my supervisor to ''met productive levels of work'', 2 previus work injuries (shoulder,and knee).
My high blood presure has prevented me from being able to work. I'm at the brink of nervous breakdown, since I do not know what's wrong with my health. X-rays, EKG and blood test show nothing.
I filed a claim for stress under workers com. but my employeer has denied it, due to ''unable to determine due to lack of evidence''. Even the last Dr. that saw me said that my employeer will now look at me as a ''liability''.
At this point don't know what to do, other than go back to work and ending up at the emergency room, and be at risk of a stroke.

The worker's compensation system is very adversial. The insuarance companies will get away with anything they can. You should obtain representation to protet your interests. The worker's compensation insuance companies have attorneys, why don't you?? Call me directly at (619) 222-3504.
