Legal Question in Workers Comp in California

Stress at work

I work with an insurance company that puts unnnecessary stress on its employees. I have been stressed for a while by my job and it reached a point where I fell sick at work thinking I was going to have a heart attack, breathing problems etc. My supervisor called the Paramedics and I was taken to the emergency room for further observation and tests. The doctor at the hospital emergency diagnoised that my sickness was stress. I followed up with my doctor the day after I was released from the hospital and he took me off work for 3 months, to return in march 07. I do not want to go back to that same job situation. I know my job caused my stress. My doctor is treating me with anti-depressant to help me to sleep at nights etc. and is referring me for counselling and psycotherapy treatment. My family life has been affected greatly by this. I am also affected emotionally, psycologically and physically. I know my job caused my stress illness and also contribute to my continued weight. I never experienced this before until after I started working there. I have been employed there for over 1 year. Can I file a workers comp case against them and at what point can I do it?

At the very least you should immediately file an Application for Adjudication of Claim with the local WCAB. I suggest that you obtain representaiton because stress claims of this type are heavily litigated.
