Legal Question in Workers Comp in California

I have been suffering from Carpel Tunnel and neck pain. During my recent QME evaluation the QME Dr. has confirmed that hand and neck pain issues I have, are work related and due to my repetitive typing work with the same employer for over last 10 years. QME Dr. has declared my case as permanent and partially disabled with provision for future medical care.

Recently I got a letter form workers compensation related Insurance company hired by my employer. The letter is titled as "What is a Stipulation With Request For Award" and they have given disability rating of 5%. A check to the amount of around $2750 has been provide to me as settlement towards permanent and partial disability of 5%.

I would like to know what are my options? How can convince the insurance company that nature of the pain and permanent damage to hands, wrists and neck should be beyond 5%?

Do I have to accept the check and sign and send back the Stipulation for Award letter or I can negotiate? What will be the possible outcome of the negotiations with the insurance company?

thank you

If you no longer work for the employer you could settle with a Compromise & Release. You need to check if all body parts effected are given proper rating in the QME report.
