Legal Question in Workers Comp in California

Can I terminate an employee for missing too much work if she is my only employee? She poses a financial hardship to my business when she's not here. She just recently filed a work comp claim. I was planning on terminating her before she let me know about the claim. Now, I am leary of terminating her.

What type of injury [part of the body] she claims and its extend may be central to an answer to your question. Lacking that information, all I can say is speak with your Workers' Compensation carrier to see what danger they foresee. An employee let go because of economic reasons is not entitled to return to work or get addiltional benefits.
