Legal Question in Workers Comp in California
Torn Meniscus
Back in 08/2003, I torn my meniscus left knee, while pushing a ultra sound machine. Saw a company doctor at that time who suggested surgery. I put off the surgery for 6 months hoping it would get better with time. After 6 months with no improvement I had the knee scope done. I am still unable to kneel down on the right knee, squat, run or walk up a flight of stairs without experiencing pain, and swelling. The doctor had graded me with 0% disability(don't know how he came up with that number since he never did a range of motion test after the scope) just sent me back to work. Now my employer insurance co. wants me to sign their stipulation form with no reward or to see a AME or QME.
--name removed--on what I should do.

Re: Torn Meniscus
I would recommend to go with an impartial AME. The reason they are claiming 0% rating is because they are claiming that you had surgery and there should not be a permanent disability after a successful surgery. You need to choose a fair AME who examines you and make comments about the nature and extent of your permanent disability and any possible future treatment that you may need (maybe a second surgery or more therapies and etc.).
