Legal Question in Workers Comp in California
When I had unemployment insurance last year, I had shoulder injury in September at job site that I was assigned by job agency for 1 day job. I was released 2 weeks later by ER clinic doctor but tried to go back to the specialist because of physical pain. It took 2 months to get authorization to take MRI from the Insurance company, but eventually I had rotator cuff surgery in March and get physical therapy up to now. Last week, care taker push me to be release soon because my therapy reached maximum 24 times. The doctor seemed to have same opinion with care taker, but truly I'm not ready to back to full time computer work as a graphic artist. I still have pain even though my condition is slowly getting better. If I go back to work but unable to work because of pain, am I eligible to get worker's comp again? I wasn't get paid for 2 months worker's comp once ER doctor released me with wrong diagnose. I'd like to get decent therapy until I get back to normal condition.
