Legal Question in Workers Comp in California
I had a verbal argument with my attorney, so I would like to know if I can speak straight to to the defendant attorneys for a settlement / this case is just waiting for my signature to get settle. I don't think I need another lawyer at this time.
1 Answer from Attorneys
Since you are officially represented by an attorney, the defense counsel is prevented by the State Bar Rules of Professional Conduct from speaking to you. It is unclear to me as to what stage the settlement is at, whether you have agreed to a figure, or what. If you have agreed, the Board in approving the settlement wil award attorney fees as a percentage of the permanent disability figure, so you might as well have the attorney do the settlement as it wil not change what he/she gets as fees.
