volunteer time when on an Off work order

the DA is charging me with GRAND THEFT: PROPERTY/ETC OVER $400. PRESENT/ETC FALSE/ETC DOCUMENT FOR COMPENSATION I was on an off work order and I volunteered at the speed way after I had knee surgery. I was not doing any of my job duties this was light work and I could stop when I wanted. we worked for a softball team a non profit the DA said the amount of money is $2,100 is this possible. I feel we are being harrassed because my daugher has a discrimination lawsuit agains't the same employer. What can we do?

Criminal Defense

If you are being charged with a crime by the DA, then you have a right to an attorney paid for by the state. Most counties have a Public Defender. You should contact the PD office immediately and request representation and discovery as to who prompted the DA to file charges. The DA will not prosecute unless a formal complaint is made. So request that discovery. Additionally, go over the allegations with a good civil attorney, as charging someone with fraud is defamation per se.

Note, however, that I am concerned, for you have admitted that you "worked." It does not matter who you were working for, or why. I suppose the real issue is whether you were collecting Temporary Disability at the same time.
