Legal Question in Workers Comp in California
Is there a waiting. For workmans comp before you get paid
1 Answer from Attorneys
IS THERE A WAITING PERIOD without benefits that must pass before the Adjuster issues Temporary Disability payments? YES.
The Labor Code does NOT require any payment for missing three days of work (until you miss 14 days... then, after the physician orders you off work for 14 days, the adjuster goes back and pays the first three days of Temporary Disability).
IS THERE A WAITING PERIOD for the payment of the Compromise & RElease Agreement? USUALLY YES, the agreement saying inside at least a 25-day time period, and most specify the adjuster has 30 days to pay (before penalties and interest kick in).
I THINK that's what you are researching. With your language limitations, please seriously consider finding a CERTIFIED SPECIALIST ATTORNEY in Workers Comp law... Certified Specialists cost exactly the same as non-specialists --- none getting any money directly from you, only from the Comp Insurer at the end of the claim -- and certified specialists passed an extra bar exam just in workers comp.
