Legal Question in Workers Comp in California

W/C settlement or hire a lawyer?

I fell at work in 2005 and hurt my wrist and back. I went through all the care and was told I needed surgery for my wrist. I had a QME done and now the doc that did the qme refused to write a report. My back is still an issue but we have done all we could. Now months later they want me to settle for 12500 with a rating given by the wc doctors. It has been almost two years now and I'd have to have another QME done but I am pregnant due to deliver tomorrow. Would it be worth it to settle or drag it out longer. I have not had my surgery for my hand yet. Will they take away future benefits and not pay for surgery?

I think you should wait after baby is born and hire an attorney to set AME (Agreed Medical Examination) in which the AME report can rate your permanent disability properly and fairly. A good AME report will contain future medical treatment and proper assessment of your permanent disability. Call me at 213.388.7070 for a free consultation.
