when will i be able to finally settle my workers comp case?

I worked in the state of CA and was injured at work. D O I 6/2003, finally in sept 2007 spinal fusion was approved and done. I had l-4, +5 fused. What is the case worth and how much longer?

You have to wait until your condition has reached the level of maximum improvement. Then the Dr.s will write reports discribing what your work limitations are [no heavy work, light lifting only, etc]. That percentage is then adjusted based upon your age and occupation. You are entitled to life long medical treatment and I would not settle that unless yo are 100% sure that you have a medical plan that will always provide treatment for this problem. You will, once the parties agree on what the PD% is [and that can take many months], have the option to either stipulate to what your damages are or settle all or part of your case for a lump sum payment.

If you do not have an attorney, get an experienced WC attorney and see what they think about the case and whether you need a full time attorney or just someone to consult with. I suspect you need someone to handle the entire case.
