Legal Question in Workers Comp in California
Will I receive a larger settlement in my WC case if I have legal representation?
1 Answer from Attorneys
That depends entirely upon what type of injury you have. The loss of any eye without need for any medical treatment is a very straight forward injury with a set percentage of permanent disability and having an attorney will not change anything. For a back injury, reasonable people can easily differ as to what the exact percentage should be so ther easily could be a 5-10% difference in what a physician might rate the injury as being, plus what the value of further medical treatment is worth. There may also be retirement or social security benefits that might be available, etc.
Speak to several applicant's attorneys and see what they say; do not let yourself be rushed into a decision by the claims adjuster. Almost always any offer they make will be available in the future too, unless in the meantime there is a medical report finding a lesser degree of disability, etc..
