Legal Question in Workers Comp in California

wokers comp time

I have been going to the wc doctors appointments either before or after work and sometimes during my lunch break. If i need a schedule change or request for a long lunch (split shift) I get approval from my supervisor. they have now sent me fmla papers. leave of absence request. I never asked for the request and any wc time that was put on time card was very minimal, i would say about less then 20 hours. I currently have fmla for family, i have used that often. At one time they wanted to demote me becuase of using family medical leave intermittantly but found out that they couldnt. i feel that they are trying to get rid of me. My question is, can they turn workers comp time into fmla time?

As long as you're not represented by an attorney they can do whatever they want with you. Technically, if they fire you because of your work injury, then you may have a 132a wrongful termination claim against them. Also, they are not suppose to make you use your FMLA for a work-related injury. If you would like to be protected, please give me a call at 818.385.0520.
