Legal Question in Workers Comp in California

work comp injury - ADA

I have a 20lb weight limit since back surgery. My employer says he can not accomodate because of my permanent work restrictions and the physical nature of the job. He did accomodate before surgery when I had a 40lb weight restriction. I feel I should be protected under the ADA. Is this correct?

No. You may have an argument under the ADA if the employer did not discuss disabilities with you or make an reasonable attempt at accommodation. However, you are not asking a comp question and should seek a labor attorney for more specific information.
