Legal Question in Workers Comp in California

Work Comp

I work in an office in a heavy phones environment. The noise from others talking and shouting has reached a point where I have migraine-type headcahes every day. Is this something I can claim as a WC claim? I realize I will need an attorney.

Yes, you can file a claim. However, when you assess the possible outcomes, more than likely you will lose your job. The employer does not need to provide you with modified work. Any physician examining you will probably find that you are able to work except for the noise. Few medications are available. So if there is no modified work, and you have reached maximium medical improviment, you have to either go back to work or find another job.
