Legal Question in Workers Comp in California
work injuriy regarding severe burns
This is somewhat lengthy but the info is important thank you for your patience. My husband a experienced welder sustained a severe 2nd and 3rd degree burn to literally half of his torso. from hip to armpit and bellybutton spine His skin was hanging off of him. It was just horrendous! He was never taken to the local hospital less than a mile away, instead the ''Saftey'' guy drove him to the ''Industrial'' health care clinic where he was taken in via the back door. From there he was given after much ''Begging'' some demerol for pain and sent driving home with silvideine cream and instructions to return the following day to have the ''Debreeding'' done This is where they scrub the burn and cut off burn skin. Then he was saturated in sividine cream and an ace bandage was applied then sent home. Then he learned that the company None of this was his fault. It was later learned that there were no ''oneway'' safty valves installed in the hoses causing the igniting of the oxegen hose resulting in his injury. They paid him personally his wages and for his med treatment at the clinic. There was no workers comp claim ever filed . Just what did they do wrong and what was my husband entitled too. He has healed quite well, physically

Re: work injuriy regarding severe burns
He can file a claim for worker's compensation benefits that covers his medical care, temporary disability benefits, settlement for permanent disability benefits and vocational rehabilitation. This applies to his physical injuries as well as his mental injuries due to burns and depression that may be resulted from his accident. He may have a third-party claim against manufacturer, operator or sub-contractors of the safety valves. Feel free to call us at 213.388.7070 for a free consultation.
