Legal Question in Workers Comp in California

work injury

I was injured at work last year that

resulted in surgery on my right

shoulder. During my surgery, I was

positioned on the op. table lying on

my right side and it ultimately

damaged my right ulnar nerve. My

right hand experienced nepropothy

sp making my right hand look

deformed. I now will be having

surgery on my right elbow to correct

the nerve damage. If this does not fix

the problem, what course of action

do I have? The workers comp.

insurance has been very good about

making sure that I see the proper

doctors and get the proper

treatment. I just need to know if I

have to take it to a legal issue, what

do I need to do?

Re: work injury

As the foreseeable consequences of your initial injury, if you have further injuries or additional injuries, thay all have to be covered by WC carrier. However, they may play games with you that your elbow injury was pre-existing or is degenerative. You may have a good medical malpractice case as well (third party civil case) against the surgeon and the hospital. Call us at 213.388.7070 if you need representation.
