Legal Question in Workers Comp in California

I have been off work for 8 months due to work related injury. I was cleared to return to work without restrictions. In the last 30 days the company has not offered a position to me. Does my employer at least have to offer a comparable job to the one I held prior to injury? My direct supervisor and human resources have not been much of any help.

When your treating doctor is sending you back to work without any restriction, it really means that you have no disability. Your employer has no excuse for not taking you back and it seems that they are acting in bad faith. I think your doctors assertion's has no foundation if you treated for 8 months and then found no permanent disability. Feel free to call us at 213.388.7070 for a free consultation.
