Legal Question in Workers Comp in California

Work related injury

My boyfriend was injured on the job 3 years ago and went through rehab/re-training and received small amount of $ to do mentioned. He was let go from company due to disability and was employed with another company a few months later, but was forced to quit due to excessive back pain and discomfort relating to back injury.

He is unable to sit/stand for long periods. Driving distances over a few miles also causes pain. The doctor

that diagnosed his ailment suggested surgery with a small

success percentage. He opted no on surgery. Does he have any recourse to receive $ for a more permanent disability?

Permanent Disability increase

It depends on how his case was settled. With a Compromise and Release, more PD is unlikely. With a stipulations with request for award, the claim can be reopened if his condition has deteriorated and there is medical evidence supporting same within five years of the date of injury. This might lead to additional PD. Alternatively, there might be an injury related to the short period of time he returned to wrok.
