worker comp td benifits

the insurance company has been under paying me ($150) for td for over a year. will they be paying a penalty fine for this?

Only if you file a penalty, which I suggest you do. You can access the form at the DIR WCAB web site. Remember you must send the petition with a proof of service. Even if there carrier eventually proves the money was not due, at least you have provided notice of your intention to review the issue before the court.

You would have to demand it in the Compromise and Release or Stipulateion or raise it at trial for an award. Contact me directly.
