Legal Question in Workers Comp in California

I have a Workers Comp case and I don't feel as though my attorney is really working on my case. I have had herniated disc surgery and he hasn't even called to check in with me. I have only had contact with his assistant and receptionist whom seem bothered when I call. I feel as though I need to find a new attorney. Is this typical? When is it time change an attorney? Thank you.

I would never, ever call a client 'to check in' post surgery. While I have personal concern for the client's well-being, i do not want a client on narcotic pain killers rushing to a ringing phone or wakened from sleep with a ringing telephone. You hire an attorney to secure the greatest benefits available through the Workers Compensation Act of the California Labor Code...not to be a friend. Contact with clients via telephone is not productive because everything that is said is forgotten in a few hours, a few days at best. I have to repeat the substance of each telephone conference in a memo, meaning telephone chats pose double work for me. IT IS TIME TO CHANGE THE ATTORNEY WHEN YOU ARE ENTITLED TO A BENEFIT UNDER THE LABOR CODE AND THE INSURANCE COMPANY REFUSES IT AND YOUR ATTORNEY DOES NOTHING TO PURSUE IT.
