Legal Question in Workers Comp in California

workers comp case

i settled my case a year ago but recently had another doctor look at the mri results that workers comp had me take. and her findings very vastly different then the ones from the workers comp doctor made. the workers comp doctor didn't find anything serious and said it was mainly aging. this most recent doctor said my neck was in really bad shape and that's why my condition has spread and gotten worse and that i might need surgery. can i re-open? my case was settled by way of compromise and release.

Re: workers comp case

No, the whole purpose of a Compromise and Release as opposed to a stipulated finding is to end the case. I always tell claimant not to settle the whole case, especialy the medical benefits.
