Legal Question in Workers Comp in California
My Worker's Comp case has been going on for 9 years and still no settlement. My attorney will not call me back or even respond to emails anymore. I have not been able to speak with my attorney in over a year; not one returned call. What are my options? Should I get another attorney? Its been NINE years, shouldn't we have a settlement by now?

I do not know any of the facts of your case, but most WC cases should be resolved within a year of the injured employee's condition becoming stabilized [permanent and stationary]. Even if your attorney considers you a pain in the neck, he/she should return your communications. Write a letter to the attorney pointing out to the extent possible of how much communications there has been for the last several years, it is 9 years without a resolution [and the passage of the time in which to reopen for any increased disability], and unless they respond fully within 10 business days you wil first find another attorney to represent you and then discharge you.
