Legal Question in Workers Comp in California

I have a number of issues under workers comp & employment issues, I had deQuervains Tendonitis and was ordered off work in July 03 since then I've had surgery on both hands for both deQuervains and Carpal Tunnel. I am frustrated with the entire situation. My attorney won't return calls, won't answer questions and won't lead me in the direction to find the answers I am looking for. I was just told by my employer they paid my medical & dental premiums in error over the last year. Even though I contacted the HR person in may 04 and was told ''the company pays them while you are out on WC leave.

I was told in dec 04 COBRA papers would be sent to me. Nothing received anything even though I have sent emails, a certified letter. I went to the Dept. of Fair Empl. & housing and filed a claim. since my employer found out I filed the claim, I have had no response at all. There are a number of issues I have. too may to list here and my attorney only wants to handle the claim itself. Knowing once he took the claim, no other attny would represent me in any civil/empl action I may have. Don't even know contact for COBRA violations. I really need help! I am ready to call the newspaper sad considering what I do for a living! please help!

Your rights to "reasonable accommodation" at work, to not be discriminated against, harassed or retaliated against for your physical condition or because you filed a workers compensation claim are separate from your workers compensation claim and should not affect whether or not an employment attorney decides to handle a civil case -- your time to file a case is running -- different time limits apply to different issues you can sue for -- feel free to send me more details at my personal email or call me at 415-522-5200 if you wish to discuss further. good luck.
