Workers' Comp

Do all workers' comp injuries mean you will get a settlement? or does a workers comp injury have to be determined a permanent injury to get a settlement?

2. If a workers' comp injury is determined a permanent injury does that mean you cannot go back to work at your same job?

not all workers' comp injuries may result in a settlement. It depends on each case. A doctor will have to determine whether or not you have a "permanent disability" or "Whole person Impairment". The doctor will also determine whether or not you require any future medical care. If the doctor that is giving the final opinion is of the opinion that there is a rateable disability and requires future medical care you will have some settlement options.

If you do have a permanent disability the employer is mandated to attempt to find work within your work restrictions or residual functional capacity. It is always best to return to work if you can do so without re-injuring yourself.
