Legal Question in Workers Comp in California
I have a workers comp injury has of 05/2004 I had been working limited duty for the Postal Service since then as of 04/2009 the USPS determine there was no limited duty work for me to do so I am now being paid by workers comp who is attempting to retrain me What about my retirement benefits thru the Post Office I would be able to retire 04/2011 Will I lose my benefits

An employer is not obligated to provide limited duty work. Probably once they do they can not end the assignment because of your injured status, but they can end it if there in fact is no such work available. I assume you probably are covered under the Federal and not state system of WC. You need to find out from Human Resources what is going to happen and then probably speak to an attorney who handled retirement matters and another who handles WC. Do you have enough vacation, sick, and time off work without pay days so that you can stretch it out to your retirement date?
