Legal Question in Workers Comp in California

Workers Comp Insurance not accepted...Medicare ok?

I have a rare movement disorder resulting from a work related accident. Just about every specialist I contact tells me they don't accept W.C. insurance...I get SS.-Will Medicare, does Medicare take the billing then (and perhaps charge back W.C.)...Or is each Health care Provider different?

If your medical condition is work-related, there are some clinics that would accept this cases on lien basis even if cases are denied by the employer's insurance company. However, the medical condition that you described has to be work-related. Upon settlement, assuming that you will enter into a Compromise and release, there will be a Medicare Set-Aside and this will determine how much will be deducted from your settlement.

With regards to your condition, how do you know it is work-related? Were you told this by your Primary Treating Physician? Do you have a PTP? Your question only raises more questions. Please feel free to contact my office if you have further questions.
