Legal Question in Workers Comp in California

What if a person is hurt on the job but the healthcare provider realizes that the patient does not have a Social Security number. The employer has a SS number but it actually belongs to another person. Will workers comp still pay even though employee is probably working illegaly as they have told the healthcare provider that they don't have a Social Security number?

Notwithstanding the lack of a Social Security No., the employer is still obligated to send you to a doctor. In fact, the employee even maintains his/her right to hire a workers' compensation attorney to prosecute his/her claim. An injured worker does not need to be a citizen or authorized to work in the US to receive Workers' Compensation benefits. You should probably get an attorney for this case.

Even if your social security number is not valid, as long as you can prove that you are suffering from a work-related injury, you are entitled to benefits. You may have a hard time receiving EDD benefits. However, If you choose a doctor from the insurance company's MPN (medical provider's network) then insurance must pay you benefits.
