Legal Question in Workers Comp in California

workers comp & UEI

I have been on W.C. since Oct 9, 2008 . I was layed off during this time. Can I also collect UEI as well as workers comp? I am not able to go back to work yet. Have not been released from the W.C. Dr. to go back and that is why my job layed me off.

No you can't collect both. In fact, if you apply for unemployement benefits, you are telling your employer that you are ready and able to work which is a contradiction with receiving worker's compensation benefits. Call us at 213.388.7070 if you need representation.
