Legal Question in Workers Comp in California

worker's comp & unemployment

Can an employee collect worker's comp. & unemployment at the same time? We had an employee claim he was injured at work, 1 day prior to being layed off. We are in the middle of downsizing the company and I think he realized his number was up at the end of the week. So he came in & claimed he has been injured 3 months prior. We sent him to the clinic and they confirmed that he was injured. The doctor couldn't tell when the injury occured, because it was a torn rotator cuff in shoulder. This employee builds patios, fences and does moving outside of work. He uses a skill saw and moves lumber at work. How can I handle this situation? Thanks.
