I have a WC injury The Treating Physician suggests surgery but I am reluctant. Both Dr. & Insurance are pressuring for Surgery. The Insurance carrier previously requested that I have surgery or settle. Recently, I received a letter to request a QME Panel because they no longer agree with the Dr.'s treatment. Questions: Should I seek legal counsel? Is it better to have the surgery and keep future medical open or settle for a lump payment towards surgery? Am I forced to either have surgery or settle? Do any WC attorneys advise with charge rather than legal representation? Please help!!!

You are certainly better off if you seek representation in your situation.Trying to represent yourself is like performing surgery on your self. No one can force you to have surgery if you decided not to have it. I think you would want to settle your case with a AME (Agreed Medical Examiner)with a lumpsum called C & R and be paid for the future medicals rather than leaving it open.
