Legal Question in Workers Comp in California

workers compensation and LMLA

Hi, i'm on workers comp aug 29th is 3 months, I was just put on another month off, I was told by my HR dept that I would be terminated. Since this was a job related event and I didn't request the FMLA and they didn't send me any notification what they were doing can they still go ahead and terminate me? thanks jeff

You should have been on paid temporary disability instead of FMLA, because your injury is work-related. If you get terminated you may file a petition under labor code 132(a) for penalty. Call us at 213.388.7070 for a free consultation about your case.
