Legal Question in Workers Comp in California
Workers Compensation reopening
I was robbed at knife point and locked in a freezer on 12/28/04 while working that night I hyperventilated had a severe anxiety attack. I was trying to do my best in dealing with the situation after it happened, but was not capable of handling it. I finally broke down and and am seeing a doctor he says I have PTSD, severe anxiety and depression. It has gotten so bad I cant even drive or do anything without having panic attacks, sleeping is nearly impossible. I am trying to get my case reopened to help me with what is going on now and with getting the bills paid from the actual date of injury. The claim rep. who getting my case reopened has been making it hard to get things going she claims their office only operates through a ''paperless'' environment The only forms sent me are through email they disagree with my doctorsdiagnosis and want me to see a QME, I cant print these papers and I only have 7 days to turn in the request What can I do? Do I have any rights? Do I need a lawyer? I am 23 and very afraid and confused please help.

Because you do over react to things, you should get a WC attorney. Make sure they are the type who will actually sit down with you and discuss what is happening, or at least have someone in the offie who will do so. Attorneys normally handle a large number of WC cases at a time so they feel they have little time to speak to their clients. You might be able to get a better idea of what the attorneys actually are like by going down to the local WC Board on their settlement Conference day and getting the permission of the the judge in charge to ask some of the injured people there what they think of their attorney. Your Dr. should try to help you more as to the stress.
If the adjuster keeps delaying, you need to go over their head to a supervisor.
I will try to supply more information in a few days from now.
